Does Home Insurance Pay For Damage To A Third Party Car?

I was leaving a house, private house on a private road, with a curve in the road. The road itself is less than 20 ft wide. Another car came around the curve and I automatically pulled further to my left. In doing so I caused my car to hit a large boulder, obviously placed to protect the verge, causing damage to my left sill and front passenger door. Is the householder liable under his Home Insurance?

    No.
    The home owner did not cause your damage. As you said “I automatically pulled further to my left. In doing so caused my car to hit a large boulder”.
    The boulder was a fixed object. It was there to be seen. You hit it.
    This is an “at fault” collision accident. You will need to file under your collision coverage (auto policy– if you have it).
    The homeowner did not cause your accident. YOU caused your accident.

    Why would anybody else be liable for the damage to your car whilst you were in control of it, the boulder is an inanimate object, as would a wall would have been. Also there is something in the word “PRIVATE” the road traffic act is not applicable, i believe the liability is your-own, Sorry:):):)

    You ran into an inanimate, stationary object on the SIDE of the road and you think the Homeowner is liable?!? This will be paid under your collision coverage and is considered a chargeable claim. No lawyer on the planet is going to touch this on an contingency basis.

    Ask the council if the boulder is allowed to be there, if they say no then you will have a claim, if they say yes, then got to the house owner and tell them, if they are descent folk they will at least meet you half way on the repairs.
